Definitions and Interpretation

“Account” refers to a personalized account set up by CBR Car Hire for a specific customer, identified by a confidential security number (Customer Account Number). This account enables the customer to access credit terms and make periodic payments based on account statements issued by CBR Car Hire, unless otherwise agreed in the Account terms. Accounts can be classified as regular, Priority, or Priority Plus Accounts.

“Account Booking” refers to a booking made using an Account and fulfilled by CBR Car Hire, as opposed to being carried out by a Fulfillment Partner.

“Car Hire Canberra” identifies CBR Car Hire, located at 8 Kriewaldt CCT, Higgins.

“Car Hire Canberra Cancellation Fee” refers to charges incurred by a customer for canceling a Car Services booking, as outlined in Clause 3.1.3 below.

“Airport Booking” refers to a booking made for transportation to or from any airport.

“Applicable Law” encompasses all laws, regulations, and legal requirements that apply within any relevant jurisdiction.

“Booking” refers to a reservation for services made by a customer, regardless of the communication method.

“Business Day” means any weekday when banks in the City of Canberra are open for business, excluding weekends and public holidays.

“Card Payment” refers to any payment made via credit card, debit card, Apple Pay, PayPal, or similar methods, as opposed to cash, cheque, or direct debit.

“CBR” refers to the defined areas of Zone 1 and Zone 2 in Canberra.

“Charges” include the fees for services, which may be outlined in the Price List, communicated during booking, or determined based on the customer’s agreed-upon rates with CBR Car Hire.

“The Festive Period” covers the time from 6:00 PM on December 24 to 11:59 PM on December 26, and from 6:00 PM on December 31 to 11:59 PM on January 1, annually.

“Pickup Address” is the location provided by the customer for vehicle pickup at the time of booking.

“Agreement” refers to the arrangement for providing services to customers, whether for Account Bookings, Non-Account Bookings, or Network Bookings, in accordance with the terms and conditions provided during the booking process.

“A Delivery Vehicle” refers to a vehicle used for transporting or delivering goods.

“Delivery Services” encompass the transport of goods both within Australia and internationally.

“Customer” or “You” refers to any individual or entity booking services.

“Data Protection Laws” include all laws related to data privacy, protection, and security in Australia or any applicable jurisdiction, including international standards like the GDPR.

“The Final Destination Address” refers to the delivery location specified by the customer during booking for transporting passengers or goods.

“Operator” refers to any individual driving a passenger vehicle.

“Service Partner” refers to a third-party private hire company.

“Merchandise” includes goods transported under the terms of the agreement.

“The Canberra Postal Zone” refers to the postal areas for Canberra as defined by the Royal Mail.

“Minors” are individuals under the age of 14.

“Network Booking” refers to a reservation for passenger services handled by a Service Partner.

“Non-Account Booking” refers to a reservation made without using an Account, where CBR Car Hire acts as an agent for the operator, and payment is made via cash, cheque, or card.

“Travelers” are the customer and any individuals allowed to travel in the passenger vehicle as part of the booking.

“Passenger Services” refers to transportation services for travelers, including their luggage or bicycles, in a passenger vehicle.

“Passenger Vehicle” includes any vehicle used for transporting passengers, including adapted motorcycles.

“Personal Data Breach” refers to unauthorized access, loss, or destruction of personal data.

“Price List” refers to a document listing service charges, which can be accessed upon request.

“Processed Data” refers to personal data provided by the customer for the purposes of providing services.

“Restricted Street” refers to areas where parking regulations prohibit a vehicle from waiting during specific hours.

“Services” include Delivery Services, Passenger Services, and other services agreed upon between CBR Car Hire and the customer.

“Regulatory Authority” refers to agencies responsible for enforcing data protection laws.

“Conditions” refer to the terms and conditions that apply, subject to updates.

“Vehicle” refers to either a passenger vehicle or a courier vehicle.

“Waiting Time Fee” is £30 per hour, billed in one-minute intervals.

“By using any of the Services, you agree to be bound by these Terms.”

“We,” “Our,” “Us” refers to: (i) CBR Car Hire for Account Bookings; (ii) the operator for Non-Account Bookings; and (iii) the service partner for Network Bookings.

“Written” or “In Writing” refers to any form of written communication, including email and SMS.

Booking Categories

Account Reservations

  1. Setting Up an Account: Before making any Account Reservation, the customer must first establish an Account with CBR Car Hire. The customer is responsible for keeping their confidential Account Number secure.

  2. Providing Account Number: When making an Account Reservation, the customer must provide their Customer Account Number. Failure to do so may result in the booking being processed as a Non-Account Reservation.

  3. Authorization: Any Account Reservation made using the Customer Account Number is deemed authorized by the customer, who is responsible for the associated charges.

  4. Payment Terms: The customer must pay all charges, priority fees, and applicable taxes (without deductions) as invoiced by CBR Car Hire within 30 days from the invoice date, unless otherwise specified.

  5. Payment Methods: Payments should be made via direct debit (preferred), check, wire transfer, or BACS.

Non-Account Bookings

  1. Agency Role: For Non-Account Reservations, CBR Car Hire acts as an agent to arrange the services between the customer and the driver. The driver enters into a direct contract with the customer.

  2. Payment Terms: The customer must pay the driver using cash, cheque, or card payment, processed by a third-party payment processor. VAT may apply depending on the driver’s VAT status.

  3. Payment Confirmation: For card payments, the customer will receive an email receipt for the quoted journey. Any additional charges will be detailed in a final receipt issued after the journey.

Passenger Services

Charges for Passenger Services

  1. Quoted Journey: The price for a reservation will be based on the journey specified by the customer, considering the route and any additional stops.

  2. As-Directed Reservation: Customers can request an “As-Directed Reservation” under specific conditions, with pricing determined by the tariff. These cannot be paid for in cash.

  3. Cancellation Charges: There will be no charge for canceling a reservation within 5 minutes of assigning a vehicle, except in specific cases as outlined in the terms.

  4. Waiting Time Charges: Waiting time for airport pickups will be free for the first 30 minutes for international flights and 15 minutes for domestic flights. Any additional waiting time will incur a fee.

  5. General Waiting Time: The first 5 minutes of waiting are free, after which a waiting time charge will apply.

General Passenger Services

  1. Vehicle Condition: CBR Car Hire will provide a vehicle in good condition, as requested by the customer.

  2. Pets and Animals: Customers must inform us of any pets they wish to transport. Animals must be secured in an appropriate carrier, with exceptions for guide dogs.

  3. Smoking and Alcohol: Smoking, alcohol consumption, and music are prohibited in the vehicles unless otherwise permitted.

  4. Luggage and Bicycle Transport: Passengers are responsible for their luggage and bicycles. CBR Car Hire may assist with loading and unloading at its discretion but assumes no liability for loss or damage.

  5. Legal Compliance: Passengers must comply with customs laws, and we are not responsible for delays due to non-compliance.

  6. Unaccompanied Minors: Minors under 11 cannot travel alone. Those over 11 may travel unaccompanied with parental consent, but we do not assume additional responsibility.

  7. Passenger Behavior: We reserve the right to refuse or discontinue transport for disruptive or inappropriate passengers.

  8. Cleaning and Damage Fees: The customer may be charged for cleaning or repairs if a passenger contaminates the vehicle.

  9. Lost Property: Any lost property will be held for 28 days, after which it may be disposed of.

  10. Bicycle Transport Limit: A maximum of one bicycle can be transported in a passenger vehicle.
